Jabalpur, October 17: In an unusual bail order, the Madhya Pradesh High Court has granted bail to Faizal alias Faizan, who was accused of raising pro-Pakistan slogans, with specific conditions aimed at promoting patriotism. Justice DK Paliwal, while granting the bail on Tuesday, directed the accused to salute the national flag 21 times and chant ‘Bharat Mata ki Jai’ twice a month until the end of his trial.

The court emphasized that these conditions were intended to instill a sense of responsibility and national pride in the accused. “He is openly shouting slogans against the country in which he was born and brought up,” Justice Paliwal noted. The order reflects an attempt by the judiciary to address the issue by encouraging the accused to reaffirm his allegiance to the country.

Bail Conditions in Detail

  1. Saluting the National Flag:
    • Faizan must salute the national flag 21 times every 1st and 4th Tuesday of each month at Misrod Police Station in Bhopal.
  2. Chanting ‘Bharat Mata ki Jai’:
    • He must raise the slogan twice on each of these Tuesdays.
  3. Regular Attendance:
    • The accused must mark his presence at the police station on the assigned days until the trial concludes.

Background of the Case

Faizan was arrested in May after an FIR under Section 153B of the Indian Penal Code (related to promoting enmity and acts prejudicial to national integration) was lodged against him at the Misrod police station. A video surfaced showing him shouting slogans in support of Pakistan and denouncing India.

The prosecution argued that Faizan’s actions were detrimental to national harmony. Additionally, the state counsel opposed bail, citing Faizan’s history of 14 prior criminal cases, suggesting he was a habitual offender. However, the defense contended that he had been falsely implicated.

Court’s Decision

While allowing bail, the High Court ordered Faizan to furnish a personal bond of ₹50,000 with a solvent surety of the same amount. The court stressed that compliance with these conditions was mandatory for his release and continued liberty.
